How we process personal data
The detailed rules for processing your personal data may vary depending on the stage and nature of cooperation with Maxon, so in order to facilitate the transfer we will describe the situations of the various groups of people whose data we process:
- Individuals interested in cooperating with Maxon
We process your personal data for the following purposes:
to present you with an offer of our services in accordance with your inquiry, i.e. based on Article 6(1)(b) of the RODO (processing is necessary to take action at the request of the data subject prior to entering into a contract);
realization of our legitimate interests on the basis of Article 6(1)(f) RODO:
direct marketing and promotion of our services - including via email and telephone, if you give your consent(s) under separate legislation;
establishment, investigation or defense against claims;
identification and verification of the identity of the customer and the beneficial owner, which we are obliged to do even before establishing cooperation as an obliged institution - on the basis of Article 6(1)(c) of the RODO, i.e. the processing is necessary for the fulfillment of our legal obligation under the Act of March 1, 2018 on the prevention of money laundering and terrorist financing
delivery of the newsletter - on the basis of Article 6(1)(b) of the RODO, in case you have consented to receive the newsletter, and thus for the purpose of fulfilling the contract for the provision of electronic services concluded in this regard.

How long we keep your personal data:
until the statute of limitations for possible claims, e.g. resulting from failure to conclude a brokerage agreement;
until the cessation of the obligation under the provisions of the Act of March 1, 2018 on the prevention of money laundering and terrorist financing;
until the date you raise an objection or revoke your consent, where the basis for the processing of your personal data is the controller's legitimate interest or your voluntary consent.
Is it mandatory to provide personal data?
Providing your personal data is voluntary, however, without it it will not be possible to present you with an offer of our services. In turn, it will be possible to undertake activities aimed at concluding a brokerage agreement only if you provide personal data covered by a statutory requirement (under the Law on Prevention of Money Laundering and Terrorist Financing of March 1, 2018).
People who have signed an agency agreement with Maxon, as well as their representatives, proxies, and persons designated for contact within the framework of the agreement
Your personal data are processed for the following purposes:
To execute the agency agreement concluded with Maxon, including conducting real estate transactions based on Article 6(1)(b) of GDPR if you are a party to the agreement, or based on Article 6(1)(f) of GDPR, i.e., to pursue the legitimate interests of Maxon if you are a representative, contact person, or proxy appointed by a party to the agreement for its conclusion or execution;
Application of financial security measures, including the identification and verification of the client's and the real beneficiary's identity, to which we are obliged as a required institution - based on Article 6(1)(c) of GDPR, i.e., processing is necessary to fulfill the legal obligation imposed on us, arising from the Act of March 1, 2018, on Counteracting Money Laundering and Terrorism Financing;
Realization of Maxon's legitimate interest based on Article 6(1)(f) of GDPR, consisting of:
Direct marketing and promotion of our services - including through email and telephone, if you give consent/s based on separate regulations;
Determination, investigation, or defense against claims;
Matching transaction parties and striving to minimize the risk and ensure the safety of the planned real estate transaction.
Additionally, if you are interested in purchasing real estate, we may process your data:
Based on Article 6(1)(a) of GDPR, i.e., on the basis of your separate consent to share data with companies cooperating with Maxon in brokering or advising on mortgage agreements or with Platforma Mieszkaniowa S.A. - to share your data with these entities.
To whom we disclose your data:
To counterparties in real estate transactions (e.g., the selling/buying party) and in justified cases to real estate agencies cooperating in a given transaction;
To real estate brokers cooperating with Maxon;
To the notary before whom the real estate transaction or related actions will take place, or to other entities directly involved in the transaction process;
To entities providing us with accounting, auditing, legal, tax, or financial services;
To entities managing our IT and telecommunication systems or providing us with IT tools;
To postal or courier companies (for correspondence);
In justified cases and meeting the requirements of the Act of April 9, 2010, on the sharing of economic information and exchange of economic data: to the Economic Information Bureau InfoMonitor Joint-Stock Company based in Warsaw.
Additionally, if you are interested in purchasing real estate, we share your data:
With developers with whom Maxon cooperates in finding buyers for properties they offer;
With entities mediating or advising on mortgage agreements - in case you consent to data sharing;
With Platforma Mieszkaniowa S.A. based in Warsaw, with which Maxon cooperates, to present you with primary market real estate sales offers - in case you consent to data sharing.
How long do we store your personal data:
For the duration of the agency agreement and for the period during which Maxon is obligated under generally applicable laws to store documents and information, including based on the Act of March 1, 2018, on Counteracting Money Laundering and Terrorism Financing, as indicated in Article 49 of the aforementioned act;
Until the statute of limitations for any claims expires, and in the case of the initiation of complaint, court, tax, or administrative proceedings - also for the duration of these proceedings;
Until the day of raising a justified objection or withdrawing consent, in situations where the basis for processing your personal data is the legally justified interest of the administrator or your voluntary consent.
Is providing personal data obligatory? Providing personal data is obligatory based on the provisions of the Act on Counteracting Money Laundering and Terrorism Financing - to the extent that this act applies to the agreement concluded with you. Additionally, providing data is necessary for the conclusion and execution of the agency agreement. In other respects, providing data is voluntary. In case of failure to provide personal data covered by the statutory requirement and data necessary for the execution of the agreement, we will not be able to conclude the agreement or provide services on your behalf.
If you are a representative of our client or a person designated by them to execute the agreement with Maxon: We additionally inform you that we process your personal data to the extent disclosed by the client, most often these are: first name, last name, phone number, and/or email address. The source of this data is the Maxon client you represent.
Individuals Seeking Real Estate (signing interest forms or property presentation cards)
We process your personal data based on:
Article 6(1)(f) of the GDPR, to realize Maxon's legally justified interest in:
Fulfilling your expectations, i.e., presenting real estate offers;
Enabling us and developers to fulfill mutual obligations;
Matching transaction parties and minimizing risk to ensure the safety of planned real estate transactions;
Establishing, pursuing, or defending against claims;
Direct marketing and promoting our services, including via email and telephone, subject to your consent under separate regulations;
Article 6(1)(a) of the GDPR, based on your consent, to share data with Maxon's partner, Platforma Mieszkaniowa S.A., and thus with developers collaborating with Platforma Mieszkaniowa, for presenting real estate sales offers in the primary market;
Article 6(1)(a) of the GDPR, based on your consent, to share data with entities collaborating with Maxon in mediating or advising on mortgage agreements.

Counterparties in real estate transactions (selling party) and, in justified cases, real estate agencies involved in the transaction;
Developers, with whom Maxon collaborates to find buyers for their offered properties;
Notaries before whom the property transaction or related activities are to take place, and other entities directly involved in the transaction process;
Entities providing us with accounting, auditing, legal, tax, or financial services;
Entities operating our IT, teleinformatics systems, or providing us with teleinformatics tools;
Entities involved in postal or courier activities (for correspondence purposes);
Entities mediating or advising on mortgage agreements – if you consent to share data;
Platforma Mieszkaniowa S.A., based in Warsaw, with whom Maxon collaborates, to present you with real estate sales offers in the primary market – if you consent to share data.
How Long We Store Your Personal Data:
Until the expiration of any potential claims, and in case of initiated complaint, judicial, tax, or administrative proceedings – also for the duration of these proceedings;
Until the day of submitting a justified objection or withdrawing consent, in case the basis for processing your personal data is Maxon's legally justified interest or your voluntary consent.
Is Providing Personal Data Mandatory?
Providing your personal data is voluntary, but without it, we cannot present real estate offers according to your expectations, including conducting property presentations.
Individuals Contacting Maxon (e.g., through the 'leave a message' form)
If you contact us – by phone, mail, email, through the 'leave a message' form, or via a web portal publishing real estate offers - your personal data is processed to respond to your inquiry, constituting our legally justified interest based on Article 6(1)(f) of the GDPR.
Depending on the subject of your inquiry, your personal data may be shared with entities providing services or IT solutions to Maxon, real estate intermediaries collaborating with Maxon, or legal service providers.
Your data will be processed for the time necessary to resolve your matter (no longer than 30 days to respond to your question) or until a justified objection is raised or consent is withdrawn.
For those who contacted us through a web portal publishing real estate offers, we additionally inform you that: we process the data you provided in the contact form (e.g., name/surname/phone number/email address). The source of these data is the real estate web portal to which you sent the inquiry.
Providing your personal data is voluntary, but without it, we will not be able to respond to your question.
Individuals Participating in Recruitments Conducted by Maxon
Your personal data is processed for the following purposes:
For recruitment process execution, as per legal requirements (for employment offers based on an employment contract under Article 221 § 1 of the Labor Code), i.e., based on Article 6(1)(c) of the GDPR;
To undertake actions necessary to conclude an employment/cooperation agreement under Article 6(1)(b) of the GDPR;
For the legally justified interest of Maxon in establishing, pursuing, or defending against claims under Article 6(1)(f) of the GDPR;
If you provide data other than legally required – based on your consent, for recruitment process execution under Article 6(1)(a) of the GDPR.

Entities providing us with HR services, recruitment agencies;

Medical facilities conducting occupational health examinations – in case of employment based on an employment contract.
How Long We Store Your Personal Data:
Your personal data is processed for the duration of the recruitment process (no longer than 3 months). In case of justified information about potential claims, personal data will also be stored until the expiration of their limitation periods.
Is Providing Personal Data Mandatory?
Providing personal data required by law is mandatory, and in other aspects – voluntary. If you fail to provide legally required personal data, your candidacy will be rejected.
Exercising Rights of the Data Subject under GDPR
Your personal data is processed for the following purposes:
To realize your rights under the GDPR/respond to your request, i.e., in connection with our legal obligation, based on Article 6(1)(c) of the GDPR;
For the legally justified interest of Maxon in establishing, pursuing, or defending against claims under Article 6(1)(f) of the GDPR.

Your personal data is processed for the time necessary to respond to your request, and thereafter until the expiration of claims related to your request.

Providing data is a legal requirement, without which we will not be able to fulfill your request.
Your Rights in Personal Data Protection
Under the GDPR, you have the following rights regarding the processing of your personal data:
Access to Data: You can obtain information related to the processing of your personal data and a copy of such personal data.
Rectification: You have the right to correct or update your data.
Erasure: You have the right to request the deletion of your data.
Data Portability: This applies if processing is based on consent or a contract, and is carried out automatically.
Restriction of Processing: For example, suspending certain operations on data or not deleting data – until the correctness is verified or a dispute is resolved.
Right to Object: You may object to the processing of your personal data in the following situations:
If your data is processed based on our legitimate interest or for the performance of a task carried out in the public interest, you can object for reasons related to your particular situation. In such a case, we will no longer be able to process the personal data affected by the objection, unless we demonstrate the existence of valid, legally justified grounds for processing that override your interests, rights, and freedoms, or grounds for establishing, pursuing, or defending legal claims.
If your data is processed for direct marketing purposes, you can object to such processing without stating any reason. In this case, we will no longer be able to process your personal data for direct marketing purposes.
Right to Withdraw Consent: If your data is processed based on consent, you have the right to withdraw that consent at any time. However, this will not affect the lawfulness of the use of your data before the withdrawal of such consent.

Right to Lodge a Complaint
Regardless of the above rights, you have the right to lodge a complaint with the President of the Personal Data Protection Office if you believe that your personal data is being processed unlawfully. However, we would request you to contact us first to amicably clarify your case before deciding to approach the authority.
Automated Decision-Making
Maxon does not use automated decision-making or profiling.
Will Your Data Be Transferred Outside the European Economic Area (EEA)?
Currently, we do not transfer or plan to transfer your data outside the EEA (which includes the European Union, Norway, Liechtenstein, and Iceland).
